Now, we can freely discuss the "merits" of this patent, but fact is that Apple lost, fair 'n square. If Apple thought that Creatives patent was bogus, they would have NOT paid. 100 million dollars is a lot of cash, no matter how you slice it. If the patent was bogus, and they still paid, Apple would be sending other companies a message that said "Want some cash? Sue us with bogus patents, we'll gladly pay!". No, Apple paid because they felt that they were really infringing and that if they had proceedd with the lawsuit, they would have lost a lot more than 100 million.
If it's a BS patent, why did Apple pay? Clearly, it was NOT a BS patent. True, the patent-system might be screwed up, but that is not the point of this discussion.

I have a feeling that Apple possibly could have won this lawsuit, but it would have taken years of red tape, legal fees, etc, and they would be taking a gamble. Apple's taken gambles in the legal process before and lost (see: Microsoft GUI case). Steve doesn't want to go through that again, so he pays off Creative. Then, being Steve, he somehow uses his RDF to get Creative to join the licensing program, which has the potential to MAKE APPLE MONEY off of this deal.
Did Apple "win" this? Of course not. They're still out 100 million. But they also came out with some interesting deals that make this not a total loss.
And finally, to answer your statement in the first paragraph: This is EXACTLY why the patent system IS messed up. Because it DOES send a message of "hey we filed this patent for something blatantly obvious, give us some money" In most cases, it will be cheaper to settle. Thus companies end up using Patents, rather than products, as a money-maker.

Wouldn't it be nice to have a phone that was able to switch to VOIP in areas with free 802.11 service if you choose to? It could be a part of .Mac Moblie that was discussed earlier. At home it would be on your existing wireless network and could sync with iTunes and all the other Apple Apps and serve as a remote. Away from a 802.11 network it could pick up the cell carrier towers. Would something like this be worth developing?

I still don't get why there is still no mention of built-in 3G support. For a device as mobile as the MBA, it's beyond me why it's still missing.

Yes, built-in 3G is more costly to buy, usually locked into a particular carrier (what do you mean I can't switch my 1500$ laptop to a new carrier ?) and with the Rev D's 2nd USB port being next to a display port, the "extension" cable is moot.
So you are quite missing tons of things. The current scheme of "get a stick from your carrier" is the best as far as costs and carrier non-attachment go. I tether to my iPhone using Bluetooth anyhow, making the USB thing even more moot.
Built-in 3G is overrated.

What I don't get is why can't Apple enable any iOS device (iPod Touch, iPhone, iPad) as an Airplay target device? Obviously iOS supports it as Apple TV can be a target for Airplay from iTunes.

I prefer to see the apps pulled. Some apps are best not available. Maybe we could add others, like the locations of the various whorehouses, and best corners for buying drugs.

I have nothing against Greenpeace or the message that Greenpeace is trying to send about the environment. If Greenpeace's presence (or more specifically, Greenpeace volunteers' presence) at other public events is any representation, I am not surprised at their behavior.

Maybe you wouldn't. I could see a use for it myself - I have a library of music so big you couldn't fit it all on any existing iPhone, and it's annoying to be out someplace and wanting to listen to a song, but you can't because you had to exclude it from your last sync. It would be preferable then for me to be able to link my iPhone to my music library and just have Apple deliver everything to me on demand... be it from the hard drive at home or from a central location.
Of course, how this is all implemented will play a big role in whether the service is useful to me or not. If I can't listen to the CDs I bought and imported into iTunes for example... that's a dealbreaker as far as I'm concerned.
This is why i would love this service, i can't even fit half my music on my phone, let alone video. I would love to be able to sync a few gigs of songs locally, and if I fancy listening to a song left on my laptop (or apple cloud) i could stream it.
I envision the best way of presenting this local and remote info is by listing all the media on the iPhone in the form of album art or text, and greying out/applying a symbol to the music/video that would require streaming. If apple implement this something like this seamlessly, then they've got a winner in my opinion.

Useless to me if it is just for iTunes purchases. Please focus on more important things, Apple.
Given iTunes is the world's biggest music store, I think their new service will be quite useful to a lot of people. It's not difficult to imagine the kinds of people who would benefit from having their iTunes purchases backed up to the cloud automatically.
I just hope Steve Jobs doesn't wake up this morning and realise his new idea is useless to caspersoong and kill the project. :(

i can buy an itunes phone right now from cingular but i dont want one
what makes them think i will buy one now because its from apple and not motorola
But you just have to know that any "Apple" phone is gonna have a darn good user interface.. and that's what I'm hoping for.. almost regardless of over all shape and design, but Apple's UI. When compared with a compatible 'Itunes" phone anyway. Pretty sure I don't want a phone with a keyboard on it. but I understand why some might.

Windows representing AFAIK at least 90% of the worldwide installed base, the dip in PC demand is all linked to a drop of Windows PC demand.
Apple's global market share progressed by 1.4 point YoY to 4.6% in Q1 2011. In US figures, Mac market share progression is similar, 1.5 to 8.5%.
Those figures do not include iPad and other tablets and include netbooks.
And a little correction: Mac growth is actually 28%, not 26% as I wrote before.

It may not be making the kind of money that iPod is making, but iTunes is indeed making money for Apple. Indeed, it has become a significant revenue story for Apple, if only recently.
In fact, contrary to popular belief, iTMS has been marginally profitable for many quarters now, although of course its profit margins are small compared to iPods and Macs.
Just remember - iTunes is profitable and a billion plus song sales a year makes it a Top 10 music retailer in the U.S., behind only the likes of Walmart, Best Buy, Target, and FYE.

There are no major differences but if i were you i'd go back and trade for the new one or just return the iPod and order a new one. Your windows is close not to upgrade..
It doesnt look like the new software features will be added to current 5G iPods. My iPod software just updated and only game functions were added.

and also, is there any chance that i might be succeeding in returning it... or even getting a refund??? i mean i took the vinyl cover off and just totally used it... can i return it right back to the apple store??

So Apple pays $100mil, and it sounds like Creative may be getting out of the iPod competition biz... and into the iPod accessory biz (which is probably more lucrative).
